This Acceptable Use Policy ("AUP") is part of the Ready Terms of Service. By using the Ready platform ("Service"), you agree to comply with this AUP. Capitalized terms not defined here have the meanings given in the Terms of Service.
1. Lawful Use
You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including but not limited to:
- The Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227
- The CAN-SPAM Act
- All applicable FCC and FTC regulations
- State telemarketing and consumer protection statutes, including Florida (FTSA), Washington (CEMA), Oklahoma (OTSA), and California (CIPA, CCPA, CPRA)
- 10DLC (10-Digit Long Code) registration requirements
- The Campaign Registry (TCR) guidelines
- CTIA Messaging Principles and Best Practices
You must not use the Service to send unsolicited messages, spam, or any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
2. Prohibited Content
You may not use the Service to send, and you warrant that you will not send, any message that:
- Impersonates any brand, business, government agency, financial institution, person, or organization that you are not expressly authorized in writing to represent — including but not limited to banks, retailers, shipping carriers, tax authorities (IRS, state tax agencies), social services (SSA, Medicare), law enforcement (FBI, DHS), the DMV, utility providers, and telecommunications carriers;
- Constitutes phishing, smishing, credential harvesting, or any attempt to obtain personal, financial, or authentication information through deception (including messages that ask the recipient to "verify," "confirm," or "unlock" an account, or that reference fake package deliveries, fake payment issues, or fake account suspensions);
- Promotes fraudulent schemes including fake prizes, fake debts, fake refunds, fake inheritances, or investment scams;
- Promotes a prohibited or high-risk industry or campaign type, including but not limited to: cryptocurrency, digital assets, tokens, NFTs, and related investment, trading, or "airdrop" solicitations; loans, lending, debt collection, debt settlement, debt relief, debt consolidation, credit repair, and payday or short-term lending; staffing, recruitment, "work-from-home," and unsolicited job-offer or income-opportunity solicitations; multi-level marketing, pyramid, "get-rich-quick," and third-party lead-generation schemes; and any other category that carriers, aggregators, or The Campaign Registry prohibit or restrict, or that is commonly associated with fraud or scams;
- Promotes cannabis, marijuana, CBD, hemp, delta-8 or delta-9 THC, kratom, or related products, which US carriers prohibit even where state-legal;
- Promotes illegal drugs, controlled substances, drug paraphernalia, or prescription medications offered without a valid prescription or by an unlicensed or online pharmacy;
- Promotes gambling, sports betting, lotteries, raffles, sweepstakes, or contests, unless separately licensed and pre-approved by Ready in writing;
- Promotes high-risk investment or securities solicitations — including "stock alerts," penny stocks, pump-and-dump schemes, forex, binary options, or unregistered securities;
- Promotes vaping products, e-cigarettes, or other nicotine-delivery devices;
- Promotes escort services, adult dating, or commercial sexual services;
- Offers “free” trials, prizes, gifts, or subscriptions with undisclosed, hidden, or negative-option recurring charges, or otherwise uses deceptive billing, auto-renewal, or cancellation practices;
- Promotes political campaigns, candidates, parties, ballot measures, or advocacy, unless the traffic is registered under the appropriate 10DLC use case where required and pre-approved by Ready in writing;
- Solicits charitable donations or conducts nonprofit fundraising, unless the organization is properly registered and the traffic is pre-approved by Ready in writing;
- Is sent to any recipient whose number was purchased, rented, harvested, scraped, or otherwise obtained without direct prior express written consent given to you;
- Is sent as part of an effort to evade carrier or platform filtering, throughput limits, or 10DLC registration — including “snowshoeing” or spreading identical or similar traffic across multiple numbers, brands, or accounts;
- Violates the SHAFT guidelines (Sex, Hate, Alcohol, Firearms, Tobacco) without all age-gating and consent requirements in place;
- Contains URL shorteners (bit.ly, tinyurl.com, t.co, and similar bare shortening services) — all links must use a domain that is publicly associated with your registered brand;
- Uses misleading sender identity, fake urgency, fabricated deadlines, or any other deceptive practice;
- Is sent to any recipient who has not provided proper consent under the TCPA and applicable state laws.
3. Consent Requirements
For every message you send through the Service, you represent and warrant that:
- You have obtained prior express written consent from the recipient as required by the TCPA, applicable state laws, and carrier policies, including any applicable "established business relationship" or transactional exemptions;
- You have collected and retained consent records sufficient to demonstrate compliance in litigation or regulatory inquiry;
- You have honored all opt-out requests (STOP, UNSUBSCRIBE, QUIT, CANCEL, END) on a real-time basis across all channels you operate;
- You are not sending to any phone number on a do-not-call list, federal Do-Not-Call Registry, or known TCPA-litigator list to the extent applicable;
- The content of your message complies with all applicable laws, the Prohibited Content rules, and carrier guidelines;
- You are sending only within permitted contact hours under the TCPA (8:00 AM to 9:00 PM in the recipient's local time zone, or stricter state limits where applicable).
4. Content Inspection and Filtering
Ready reserves the right, in its sole discretion and without prior notice, to inspect, filter, delay, quarantine, or refuse delivery of any message that we reasonably believe violates this AUP, the Terms of Service, any law or regulation, or any carrier or aggregator policy. Automated pre-send filters and post-send compliance audits may block or flag messages. Ready shall have no liability for any delay in delivery, non-delivery, loss of business, or other damages arising from any action taken under this section.
5. Enforcement
Violations of this AUP may result in:
- Automatic blocking of non-compliant messages with a 5× credit fee
- A per-violation fine of $500 for each message that is fraudulent or that otherwise violates this AUP, the Prohibited Content rules above, or the Terms of Service, charged to your account or payment method on file
- An escalated fine of $2,000 for each confirmed phishing, impersonation, brand-fraud, or SHAFT campaign (a coordinated set of violating messages), and $10,000 for burn-and-rotate brand registration, evasion of a suspension or ban, or any willful or repeat violation after a warning — charged to your account or payment method on file, in addition to the per-message fine above
- Carrier pass-through fees for any fines or penalties incurred by Ready due to your messaging traffic
- Suspension or termination of your account, with or without notice
Ban evasion. If your account is suspended or terminated for a violation of this AUP or the Terms of Service, you may not create, register, operate, or use any other account — directly or through any related person, entity, sub-account, reseller, or agent — to circumvent that suspension or termination. Any account used to evade a ban may be terminated immediately, and you remain jointly and severally liable for the same $500-per-message fines and all other enforcement remedies described above for any message sent through any such account.
